Warrant of Fitness

It is useful to review your affairs every few years. Changes in personal circumstances, employment, and business may result in the need to amend or renew certain legal documents. We suggest you undertake our warrant of fitness to see if there are any areas that need attention. This can be emailed to us upon completion, and we will respond with our suggestions for action.

Ask yourself:

2. In my will have I appointed guardians for my children who are under 20?
3. Do I have Enduring Powers of Attorney in place in case I lose my capacity to handle my affairs?
4. Have I reviewed my home title ownership in conjunction with my will?
5. Is My Mortgage covered by appropriate Insurance cover?
6. Do I have Accident and Illness Insurance to protect my income?
7. Are my Life Insurance Policies owned by a person or Trust to whom payment is to be made upon my death?
8. Do I really understand how my Superannuation Scheme works? Have I considered an equalising relationship property agreement?
9. Am I fully aware of my Personal Guarantee and contingent liability on leases and financing?
10. Have I diarised the renewal date of my Lease more than three months ahead?
11. As an owner of commercial rental property, do I fully understand my obligations under the Health & Safety in Employment Act 1992, The Resource Management Act 1991, The Building Act 2004 and The Residential Tenancies Act 1986?
12. As a Company Director, do I fully understand my responsibilities under The Companies Act 1993?
13. As a Company Director, do I have Indemnity Insurance?
14. Do I have a Family Trust structure in place or have I sought advice on this?
15. Have I reviewed my Family Trust Deed with a Lawyer specialising in Family Trusts within the last 3 years and am confident that no changes are needed to be made to the Deed?
16. Have I been completing gifting to my Trust each year?
17. Do I Really know how my Family Trust operates and have I been correctly maintaining all of the necessary documentation and meeting any Trustee obligations?
18. Have all of my assets and investments been correctly transferred to my Family Trust?
19. Have I completed a Memorandum of Wishes for my Trustee's guidance?
20. Do I have a written Employment Contract (Employer or Employee)?
21. Do I need a Relationship Property Agreement?
22. Being separated (but not divorced), have I changed my will?
